Access to the Site and the Chatbot is free and open to anyone with an internet connection, subject to the age conditions described in ARTICLE 4. All costs related to equipment, software, or internet access are solely the User’s responsibility, including the proper functioning of their device and connection.
The Publisher uses reasonable efforts to provide high‑quality, continuous access to the services. However, no result obligation is assumed regarding availability. Interruptions may occur due to maintenance, updates, or other technical reasons. No compensation can be claimed in case of downtime, regardless of duration.
4.1 – Age limit
In France, the minimum digital age of consent is 15. Access to and use of the Site and the Chatbot are reserved for individuals aged 15 or older. In France, persons under 15 cannot lawfully consent on their own to the processing of personal data; prior explicit consent from their legal guardian(s) is required.
By accessing or using the Site, the User represents and warrants that they are at least 15 years old. Users under 15 are not permitted to use the Site without prior, verifiable parental consent—even if a different country’s law is more permissive.
4.2 – Guidance for users aged 15–18
Users aged 15–18 are encouraged to inform their parents or legal guardians about their use of the Site and the Chatbot, especially when personal or mental‑health related information may be shared. Ube strongly recommends that parents/guardians supervise minors’ online activity and reinforce good security and privacy practices.
The Publisher may request proof of age at any time and suspend or remove access in case of doubt about the authenticity of the declared age.
5.1 – Purpose of the Chatbot
The mental health–focused Chatbot provides informational support and general guidance. The content and responses, including those generated by the Chatbot, do not constitute personalized medical advice and are not a substitute for diagnosis or treatment by a qualified professional (e.g., psychologist, psychiatrist, physician).
5.2 – Medical liability limitation
Ube does not provide medical, paramedical, or psychotherapeutic services. The Publisher disclaims liability for misinterpretation, misuse, or consequences arising from the application of information, guidance, or suggestions provided by the Chatbot. In case of doubt, acute distress, suicidal thoughts, or any mental‑health emergency, contact a qualified professional or emergency services immediately.
5.3 – External guidance and resources
When the Chatbot directs Users to external organizations, platforms, or resources (helplines, support services, etc.), Users are responsible for verifying the reliability and relevance of those resources. The Publisher is not responsible for the content, services, or practices of third parties referenced by the Chatbot.
If paid features or services are offered (e.g., premium subscriptions or downloadable content), all sales are final due to the digital nature of the products. No refunds are granted once access is purchased or files are downloaded, to prevent duplication or unauthorized distribution. By making a purchase, the User expressly waives any refund or chargeback request.
We strongly encourage Users to contact the Ube team with any questions or uncertainties before purchasing. Our team can provide the information needed to make an informed decision.
Users are responsible for risks related to their credentials (where applicable) and for all interactions on the Site or via the Chatbot. Any use of the Site or Chatbot, including sharing sensitive information, is at the User’s sole responsibility.
Users agree to be respectful (where interactions exist) and comply with the law when communicating or publishing content on the Site. Sharing content that is unlawful, hateful, defamatory, or incites violence is prohibited.
Users must refrain from fraudulent use, including attempts to access services, accounts, or data belonging to others or to the Publisher without authorization. Abuse or illegal use may lead to civil and/or criminal proceedings.
In case of serious breach, the Publisher may suspend or remove access without notice and, if necessary, initiate legal action.
Ube, as Publisher, uses best efforts to ensure the accuracy of information on the Site and a high level of service availability. However, the Publisher cannot be held liable for:
The Publisher may suspend access to all or part of the Site, including for maintenance or updates, or for any reason deemed necessary to preserve service integrity and data security.
No compensation may be claimed for any of the above interruptions or malfunctions, regardless of cause or duration.
All elements of the Site (including texts, images, graphics, logos, videos, databases, and other published content) are the exclusive property of Ube or its partners and are protected by applicable intellectual property laws and international treaties.
Any reproduction, representation, modification, publication, or adaptation of all or part of these elements, by any means, is prohibited without prior written authorization from the Publisher. Violations may result in civil and/or criminal proceedings.
Users are granted a personal, private, non‑exclusive right to use Site content. Any use beyond these Terms is strictly prohibited.
10.1 – Collection and purposes
In connection with registration (if any), use of the Chatbot, or simple browsing of the Site, personal data may be collected (email address, browsing information, preferences, etc.). Data is processed in accordance with applicable law, including the GDPR and French data‑protection rules.

10.2 – Sensitive data
Mental‑health information may constitute sensitive data under the GDPR. Its processing requires explicit consent from the User or, for Users under 15, from their legal guardian. Ube implements enhanced security measures (encryption, restricted access, etc.) to protect such data.
10.3 – Specific protection for minors
As per ARTICLE 4 and French law (GDPR, etc.), minors under 15 cannot use the Site without verifiable parental consent. Minors aged 15+ may consent to processing if they understand its implications. Ube recommends that parents/guardians closely monitor Chatbot use and sharing of mental‑health information.
Where personal data is collected from minors under 15, Ube will implement appropriate controls to verify parental consent. If such verification is not possible, access to certain services may be refused or suspended.
10.4 – User and legal representative rights
Under applicable law, Users (or their legal representatives) have the right to access, rectify, delete, restrict, object to, and port their personal data. These rights can be exercised by contacting the Publisher atwithubecontact@gmail.com. Proof of identity and/or authority may be required.
Ube commits to respond within legal timeframes (one month, renewable where applicable). If unresolved, Users (or their legal representatives) may lodge a complaint with the CNIL.
10.5 – Automatic account and data deletion
Users can delete their account and associated personal data at any time via the “Delete my account” option available in account settings.
10.6 – Data retention period
Personal data is retained for the duration of active account use. If a user deletes their account or after 12 months of inactivity, all personal data is promptly deleted.
10.7 – Right to complain to the supervisory authority
If you believe your GDPR rights are infringed, you can file a complaint with the CNIL via its official website: https://www.cnil.fr.
For any subscription sold on the Site, payments are processed by Stripe, our secure payment provider. Ube does not store, access, or process Users’ payment card data; such information is handled exclusively by Stripe in a secure environment.
Users should review Stripe’s terms and privacy policy before paying. Ube is not responsible for issues attributable to the payment provider, including malfunctions, security incidents, or billing problems.
Because the Chatbot may process sensitive data (mental‑health data) and may be used by minors aged 15+, Ube applies privacy‑by‑design principles and, as required by the GDPR, conducts a Data Protection Impact Assessment (DPIA) when appropriate.
A DPIA identifies and assesses risks related to processing sensitive data, helping implement appropriate technical and organizational measures to ensure confidentiality, integrity, and availability. Findings can be shared with the CNIL upon request and help Ube continuously improve data‑protection practices.
Ube reminds Users that, in a medical, psychological, or other emergency requiring immediate intervention, they must contact emergency services (e.g., SAMU, firefighters, police) or a healthcare professional immediately.
The Chatbot is neither designed nor authorized to manage acute crises or emergency calls. The Publisher disclaims liability for outcomes of poorly managed emergencies or failures to contact competent authorities.
These Terms are governed by French law. In the absence of an amicable settlement, any dispute relating to performance, interpretation, or validity falls under the exclusive jurisdiction of the competent French courts.
If any provision of these Terms is held null, invalid, or unenforceable by a competent court, that provision will be deemed unwritten without affecting the remaining provisions. Failure by Ube to enforce any provision or right at any time shall not constitute a waiver of such provision or right.

17.1 – Nature of the Chatbot and limitations
The Chatbot is powered by Artificial Intelligence (AI). Despite efforts to tune it for caring, reliable, and relevant responses, the AI may occasionally produce inaccurate, incomplete, or inappropriate outputs. Ube implements safeguards and filters to mitigate these risks but cannot eliminate them due to AI’s probabilistic nature.
Users acknowledge that certain responses may not reflect the Publisher’s position and that AI outputs are not a substitute for medical diagnosis or therapeutic follow‑up. Information provided under normal use is general and not a personalized prescription. Users should exercise judgment and seek professional advice where needed.
17.2 – Normal use and prohibited misuse
Users must use the Chatbot for its intended purpose (well‑being guidance). It is strictly forbidden to coerce the AI into producing content outside its normal use, including prompts that are unlawful, unethical, or designed to bypass safety filters.
Attempts to manipulate the AI (e.g., promoting hateful, discriminatory, or unlawful content; seeking others’ personal information) violate these Terms and may lead to immediate suspension or removal of access. Ube may take legal action if such acts cause moral, material, or legal harm to the Publisher or others.
17.3 – Disclaimer for misuse
If a User employs methods or prompts that alter the AI’s intended behavior or bypass the Chatbot’s protections, the Publisher disclaims responsibility for any outputs produced. The User assumes full responsibility, including legal liability, for any unlawful, inappropriate, or harmful content the AI may generate under abnormal or malicious use.
More broadly, if a User goes beyond standard, reasonable use of the Chatbot, the Publisher cannot be held liable for direct or indirect, material or immaterial harm resulting from such misuse. Users must comply with applicable law, including the protection of minors, intellectual property, and others’ reputation.
17.4 – Safeguards and self‑moderation
Ube deploys technical and methodological safeguards (keyword filters, moderation models, sensitive‑content detection, etc.) to foster kindness and safety in exchanges. These measures cannot guarantee zero risk; Users are asked to report any issues using the contact in ARTICLE 16so that fixes or adjustments can be made where needed.
17.5 – Reliability of responses under normal use
In most cases of normal use—i.e., when Users converse reasonably and in good faith about mental‑health topics—the responses are relevant, supportive, and aligned with the Site’s goals. Ube strives to maintain a high level of reliability and consistency so the experience remains constructive, safe, and ethical.
